1. Introduction

Welcome to the artist’s website! These terms and conditions govern your use of this website; by using this website, you accept these terms and conditions in full.

2. Intellectual Property Rights

All intellectual property rights in the artwork displayed on this website are the property of the artist. You may not reproduce, modify, distribute, or use any of the artwork without the artist’s express written consent.

3. Commission Paintings

a. Pricing: The price for each commission painting will be determined on a case-by-case basis, depending on the size, complexity, and other factors of the painting. The artist will provide an estimate to the client before beginning work on the painting.

b. Payment: The client will be required to make a non-refundable deposit of 50% of the total cost before the artist begins work on the painting. The remaining 50% will be due upon completion of the painting. Payment can be made through PayPal or other agreed-upon payment methods.

c. Timeline: The timeline for each commission painting will be determined on a case-by-case basis and will be agreed upon by the artist and the client before work on the painting begins.

d. Changes and Refunds: The artist will work with the client to make any desired changes to the painting throughout the painting process. However, once the painting is completed and delivered to the client, no changes or refunds will be allowed.

e. Prints: The artist may offer prints of the commissioned painting for sale if the subject matter is deemed suitable for printing. If the artist and client agree that prints can be sold, the artist will offer a discount of 20% off the total cost of the commission painting. The artist will retain all intellectual property rights to the artwork and will have the right to sell prints of the artwork to other parties. The client will have no rights to sell or distribute prints of the artwork without the artist’s express written consent.

If the artist and client agree that prints can be sold, the artist will provide the client with a copy of the print file and grant the client a non-exclusive, non-transferable license to print and distribute the artwork as agreed upon. The artist will not be liable for any loss or damage arising from the client’s use or distribution of the print file.

4. Limitations of Liability

The artist will not be liable for any loss or damage arising from the use of this website or any artwork displayed on this website. The artist will not be liable for any loss or damage arising from commission paintings, except in cases of intentional misconduct or gross negligence.

5. Privacy Policy

The artist will collect and process personal data from users of this website in accordance with applicable data protection laws. The artist will not sell or disclose this personal data to any third parties except as required by law or with the user’s consent.

6. Termination

The artist may terminate your use of this website at any time, without notice and for any reason.
