1. Definitions

Seller
John C Gerrie, trading as John Gerrie Artwork.

Customer
The individual or business placing an order on the Website.

Contract
The agreement formed when the Seller accepts the Customer’s order.

Goods
Any watercolours, prints, originals or other items offered for sale via the Website.

2. Governing Law & Jurisdiction

These Terms & Conditions are governed by the laws of Scotland.

2.1 Dispute Resolution

In the event of a dispute arising from these Terms, both parties agree to attempt to resolve the issue through negotiation in good faith. If a resolution cannot be reached, the dispute shall be submitted to mediation or arbitration in accordance with the laws of the United Kingdom. The exclusive jurisdiction for any legal proceedings shall be the courts of Scotland.

3. Ordering & Payment Ordering & Payment

  1. Order Placement: All orders must be placed via the online checkout on the Website.
  2. Payment Terms: Payment is due in full at the time of order. We accept major credit/debit cards and direct bank transfer.
  3. Order Acceptance: A contract is formed when the Seller sends an order confirmation email.
  4. Payment Clearance: Goods will not be despatched until payment has cleared.

4. Prices, Availability & VAT

  • Prices: All prices shown include VAT at the current UK rate where applicable.
  • Currency: Prices are displayed in GBP.
  • Availability: Goods are subject to availability; we reserve the right to withdraw any item at any time before dispatch.

5. Delivery & Packaging

  1. Dispatch Times: We aim to despatch all Goods within 5 calendar days of payment clearance.
  2. Delivery Methods: Standard UK delivery is by Royal Mail; international delivery via courier.
  3. Free Postage: Postage and packaging are free within the mainland UK for orders over £15.
  4. Packaging: Goods are carefully packaged to minimise risk of damage in transit.
  5. Customs & Duties: For international orders, any customs charges, duties or taxes are the Customer’s responsibility.
  6. International Shipping Costs: Please request international shipping costs via email or our contact form before placing your order. 

6. Cancellation & Returns

6.1 Cancellation by Customer

  • You may cancel your order in writing (email acceptable) within 14 calendar days of payment, provided Goods have not been despatched.
  • To cancel, email [email protected] with your order number and reason for cancellation.

6.2 Returns for Change of Mind

  1. Notify the Seller in writing within 7 calendar days of delivery.
  2. Return Goods at your cost within 14 calendar days of notification.
  3. Goods must be unused, in original packaging, and in re‑saleable condition.
  4. Refunds (minus outbound postage) will be issued within 14 calendar days of receiving the returned Goods.

6.3 Faulty or Damaged Goods

  • Contact the Seller within 7 calendar days of delivery if Goods arrive faulty or damaged.
  • We will arrange a replacement or full refund (including postage) at no extra cost.

6.4 Non-Returnable Items

  • Custom-made or personalised Goods are non-returnable unless damaged or defective on arrival.
  • To make a claim, notify us within 7 calendar days of delivery and provide photographic evidence.
  • If your claim is accepted, Clause 6.3 will apply.

7. Lost or Damaged in Transit

  • If an order is lost or damaged in transit, notify us within 14 calendar days of the expected delivery date.
  • We will investigate with the carrier and either resend the Goods or issue a full refund.

8. Intellectual Property

Intellectual Property

  • All content on the Website, including text, images and designs, remains the intellectual property of John C Gerrie.
  • You may not reproduce, distribute or create derivative works without prior written permission.

9. Limitation of Liability

  • The Seller’s liability for any claim arising under these Terms shall not exceed the total price paid for the relevant Goods.
  • We are not liable for any indirect or consequential losses.

10. Data Protection & Privacy

  • We collect and process personal data in accordance with our Privacy Policy (link in footer).
  • By placing an order, you consent to our processing of your data for order fulfilment and marketing communications (you may opt‑out at any time).

11. Amendments

  • The Seller reserves the right to amend these Terms & Conditions at any time by updating this page.
  • Your order is governed by the Terms in force at the time of purchase.
